Setting up an estate does not mean your family will avoid probate. It allows people to decide who get what, without the state taking everything, especially if they were to die intestate (without a will). She also represents them in probate court. Shannon says it is important to have a litigater, whose job it is to fight for you and your family. A litigater is not afraid to fight for you and what you needs, not only in setting up your will, but representing you in probate court.
After a death, she says she sees two main emotions – grief and greed. Usually it’s grief, but there are times when, especially if there are multiple marriages with children involved, people want to fight for what they belief is due them. The cost for litigation can get quite expensive, but is more expensive if no steps have been taken prior to death.
